The foundation of a democratic society is the public’s right to know what their government is doing. Public business must be performed in an open and public manner so citizens can fairly evaluate the performance of public officials and the decisions they make. For that reason, New York has a Freedom of Information Law (FOIL). Other states have similar laws. The Federal government has the Freedom of Information Act (FOIA).
Village of Mamaroneck FOIL Appeal 6369
6369 is a FOIL request for the “152 pages of documents to Mayor Murphy” sent by Village Manager Jerry Barberio per an email sent to me as a blind copy (see linked story below).
The 6369 records are mostly redacted but appear to be be a lot of the same material Barberio “leaked” to me in June.
Village of Mamaroneck FOIL Appeal 6507
6507 is a FOIL request for “All expense reports, along with all receipts and invoices and payments, for all members of the Board of Trustees from January 1, 2018 until the present.@
Village Manager Jerry Barberio, in his capacity as Records Access Appeal Officer of the Village of Mamaroneck denied my appeal after months of not meeting the 10 day appeal deadline on the grounds that months late he is “happy to state that the records you requested were able to be obtained sooner than
originally expected and are attached. Therefore, your appeal has been denied.”
Not only is this another failure to follow the FOIL Law but the records were notattached. I wrote back to his assistant.
Your letter from Mr. Barberio states “we are happy to state that the records you requested were able to be obtained sooner than originally expected and are attached. Therefore, your appeal has been denied.”
Setting aside the issue that decision on my appeal is required within 10 days and came months late, and that the denial is non-responsive to my appeal, and that the 9/9/22 email is well after the “date certain” originally provided, I see no attachment.
Was this email with the letter supposed to include the records I requested? It does not.
Please advise soonest.
